Expanded CFIUS Jurisdiction Under FIRRMA Regulations: An Overview

Two years after the passage of the Foreign Investment Risk Review Modernization Act of 2018 (“FIRRMA”)1 by Congress, on February 13, 2020, final implementing regulations governing the jurisdiction and procedures of the Committee on Foreign Investment in the United States (“CFIUS”) became effective. The final regulations make several changes to CFIUS’s mandate, including expanding, clarifying, and, in some cases, placing boundaries on CFIUS’s jurisdiction.
